Who is Responsible for the Fireworks Accident & Injuries?

Once the cause has been identified, we turn our efforts to finding out who is responsible.

If the injured party is a bystander or non-participant, the fault lies with the user/operator of the fireworks, the manufacturer, the retailer, or all three. Meier Fire Investigation can help you sort out who is to blame for the injuries and why.

Sometimes the user of the firework is injured but it may not be their fault.

If they followed proper safety procedures and product directions but an injury occurred anyway, the product’s manufacturer and/or retailer may be at fault.

I’ve handled cases involving consumer fireworks, professional grade fireworks, illegal fireworks, sparklers, bottle rockets, Roman candles, pretty much anything that’s on the market.

I’m Richard Meier. I am a fire and explosion investigator and I’m often called as a fireworks accident expert.

Oftentimes when fireworks are used, it’s during holidays when people’s perceptions are often altered by, the things, the things you typically do at party, there’s drinking going on, it’s dark. And how people perceive the accident is not always accurate.

The information that’s needed to properly investigate a fireworks accident is you need to know: the location at the time , the people involved, the types of fireworks, who was using the fireworks, who was actually injured, any witnesses present and any other pertinent information that you can find.

Knowing where the fireworks were bought may come into play in a case where you’re dealing with a defective product.

In order to determine fault in a fireworks accident, you need to know how the accident occurred. Was it a defective product where the fuse burned too quickly? Is it a case where the person using the fireworks was misusing the fireworks? Was the case where the fireworks were shot by one party and injured another party?
